1. About these terms

These Terms of Service ("Terms") govern your use of services supplied by Simply Local Hosting (ABN 78 752 965 845) ("we", "us", "our"). By creating an account or purchasing a service you agree to these Terms, our Privacy Policy and our Acceptable Use Policy.

2. Eligibility & your account

You must provide accurate, current account and contact details and keep them up to date in your customer portal. You are responsible for activity under your account and for keeping your password secure; we recommend enabling two-factor authentication.

3. Services, fees & billing

Fees are payable in advance. Subscriptions (hosting, email, Microsoft 365, SSL) are billed monthly or yearly as selected and renew automatically until cancelled. Payments are processed securely by our payment provider, Stripe; we do not store your full card details. Prices are in AUD and include GST where applicable.

4. Domain names

Domain registrations, renewals and transfers are processed through our wholesale provider, Synergy Wholesale, and are subject to the policies of the relevant registry — including auDA for .au domains and ICANN for generic TLDs. You agree to the applicable registrant agreements and warrant that the registrant and eligibility information you provide (including for .au eligibility) is accurate. Registry decisions regarding registration, renewal, transfer or disputes are final, and we are not liable for those decisions. Domains are sold as yearly registrations that auto-renew unless you disable auto-renew before the renewal date.

5. Renewals & auto-renewal

Subscriptions and domains renew automatically. You may cancel or disable auto-renew at any time from your portal; access continues until the end of the paid period. It is your responsibility to keep a valid payment method on file. We are not liable for a service or domain lapsing due to a failed or declined payment.

6. Refunds

Our Refund Policy forms part of these Terms. In short: eligible web hosting and email hosting plans include a 30-day money-back guarantee; domain registrations, renewals and transfers, SSL certificates, Microsoft 365 subscriptions and the .au Registry Lock add-on are non-refundable once submitted to the registry or provisioned; and refund eligibility is void where these Terms or our Acceptable Use Policy have been breached. Nothing in these Terms limits your rights under the Australian Consumer Law.

7. Acceptable use

Your use of our services must comply with our Acceptable Use Policy. We may suspend or terminate services that breach it.

8. Suspension & termination

We may suspend or terminate services for non-payment, breach of these Terms or the Acceptable Use Policy, or where required by law or a registry. Following termination, stored data may be deleted; please keep your own backups.

9. Your responsibilities

• Maintain your own backups of your data.
• Ensure your content and use comply with applicable laws and these Terms.
• Keep your account details and payment method current and secure.

10. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted, error-free service. Scheduled maintenance and factors outside our control may affect availability.

11. Limitation of liability

To the extent permitted by law (and subject to any rights you have under the Australian Consumer Law that cannot be excluded), we are not liable for indirect, incidental, special or consequential loss, including loss of profits or data. Our total liability is limited to the fees you paid for the affected service in the 6 months before the claim.

12. Privacy

We handle personal information in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of that jurisdiction.

14. Changes

We may update these Terms from time to time. Changes take effect when published to this website; continued use constitutes acceptance.
